With the credit agreement, the registered security on the Paradise property, the draw records, the deposit to his account and the transfer to escrow or the company. The loan must be his personal obligation, not the business's.
Personal debt secured on a personal asset is capital at risk
Consular guidance treats capital as at risk when the investor stands to lose it if the enterprise fails. Money borrowed against the investor's own home qualifies, because the lender's recourse is to his house, not to the U.S. business; money borrowed against the business's assets does not, because he could walk away and let the lender take the business.
The file should therefore show the line-of-credit agreement in his name, the mortgage or charge registered against the Paradise property, the draw confirmation, the deposit into his personal account, any currency conversion, and the wire to the escrow agent or the company, all in matching amounts and dates. It should also show that the U.S. company has not guaranteed the loan and that the founder has not co-signed it.
Include his recent tax assessments and a statement of personal assets to demonstrate he can service the debt without stripping the business's early cash flow. A lawful source is also required, and a Canadian bank's secured line of credit documents that source cleanly.
