Conception Bay South E-2 guide: what the business must look like at renewal

THE SHORT ANSWER

Hypothetical example: a Conception Bay South couple buy an American coffee roasting and wholesale business and are granted treaty investor status. The first grant is decided largely on a plan, while every renewal afterwards is decided on results measured against that plan. Building the initial file with the renewal already in mind changes what a sensible business plan should promise, and it changes what records the business starts keeping from its first month of trading.

01

Renewal re-examines the same conditions on new facts

A treaty investor's status can be extended for as long as the enterprise continues to qualify, but each application looks again at the conditions: the enterprise must still be real and operating, still not marginal, still at least fifty percent owned by treaty nationals, and the investor must still be developing and directing it. What has changed by then is the evidence available. Instead of projections there are financial statements, payroll registers, tax filings and customer contracts, and those will be compared against what the original plan said would happen.

02

Write a plan you can actually be measured against

This is the practical consequence. A business plan promising rapid hiring and revenue growth may help a first application and hurt every one afterwards, because the gap between the promise and the outcome becomes the subject of the renewal. A conservative plan that the business exceeds is a far better position. Set out hiring by role and date in numbers the business can meet, base revenue projections on contracted or historically demonstrated sales, and state the assumptions openly so that a shortfall caused by an identified risk can be explained rather than looking like a failure of credibility.

03

Keep the evidence as you go, not at the end

Decide at the outset what the renewal file will contain and collect it continuously: payroll records for American employees, financial statements prepared on a consistent basis, tax filings, wholesale contracts and purchase orders, lease renewals, and a short annual note recording what happened against the plan and why. Keep the ownership records current, since a share issue to an outside investor could threaten the treaty nationality of the enterprise. Reconstructing three years of evidence in the month before a renewal is expensive and usually produces a weaker file than one assembled quarterly.
