FOR SPECIALIST TEAMS · CONCEPTION BAY SOUTHConception Bay South

Your expertise.Across borders.

L-1B covers an employee with special knowledge of the petitioning organisation's product, service, equipment, techniques or procedures, or an advanced level of knowledge of its processes. It also requires one continuous year of qualifying employment abroad within the three years before the petition, a qualifying parent, branch, subsidiary or affiliate relationship between the foreign and United States entities, and both entities to remain actively doing business throughout the assignment. Companies frequently build a petition around indispensability, arguing that nobody else can do the work. That is a business fact, not the statutory test, and it is a common reason a strong-sounding case fails. A Conception Bay South contract sterilisation company transferring the specialist who owns its validated process files has to show what the knowledge is, not merely that one person holds it.

IN THIS GUIDE · Being the only person who does it is not the legal test

Start with the L-1B eligibility and application overview

01

Describe the knowledge, then attach the person

Hypothetical example: a Conception Bay South company that provides contract sterilisation and validation services for medical devices wants to send the quality specialist who wrote and maintains its validated process files to an American subsidiary. Start by naming the knowledge itself: the company's cycle development method, its bioburden and dose-audit protocols, the parametric release criteria it uses, and the validation rationale documented in its own files. Then show the specialist's authorship. A description that begins and ends with the person is the weaker version of the same case.

02

Indispensability and specialisation are different arguments

A small company often has one person per function, which makes everybody indispensable and proves nothing about specialised knowledge. The regulation asks whether the knowledge is special to the organisation or advanced within its processes, and a reviewer will not accept staffing thinness as a substitute. Where the honest position is that the company simply has nobody else trained, say so, and then explain separately whether the knowledge itself is distinctive. Sometimes it is and the case is strong; sometimes it is not and a different route should be considered.

03

Regulatory and procedural knowledge can qualify

Specialised knowledge is not limited to engineering. Knowledge of a company's own validated processes, its quality management system, its customer-specific qualification protocols and its documented rationale can be special to the organisation even though the underlying standards are public. The distinction is between knowing the standard, which many people do, and knowing how this organisation implements, documents and defends it, which is learned inside the company. Make that distinction explicit rather than leaving a reviewer to draw it.

04

Offsite work and the five-year limit

If the specialist will spend time at customer sites qualifying equipment, the petition must show that the placement is not essentially labour for hire and that the specialist remains controlled and supervised by the petitioner while applying its specialised knowledge. L-1B status is limited to five years, with previous time in L or H status counting toward the total. Both points should be settled before the assignment is designed rather than after it has been sold to a customer.
