THE SHORT ANSWER

Hypothetical example: a Conception Bay South mechanical engineer with a provincial professional designation is offered a role with an American manufacturer. Engineer is a listed profession whose qualification is a baccalaureate or licenciatura degree, or a state or provincial licence. Knowing which limb you are relying on decides what the file has to contain, and it decides what to do when the destination state also regulates the practice.

01

Choose the limb of the qualification and lead with it

The Appendix 2 entry for Engineer offers alternatives: a baccalaureate or licenciatura degree, or a state or provincial licence. A mechanical engineering degree from a Canadian university satisfies the first limb on its own, and a provincial professional designation satisfies the second. Where both exist, lead with the degree because it is the simpler document to verify, and include the designation as supporting evidence of standing. State in a covering note which entry is relied on and which limb, so that an officer is not left to work out the theory of the case from a stack of certificates.

02

Keep the state licensing question separate and visible

Many American states regulate the practice of engineering and restrict certain activities, particularly work offered to the public or requiring a professional seal. That is a state law question distinct from the TN qualification, and a TN admission does not authorise practice a state licenses. Ask the employer directly whether the role involves sealing documents or otherwise requires state licensure, and if it does, start that process early because it involves examinations, experience verification and board timelines. If it does not, have the employer say so in the letter, which removes an obvious question before it is asked.

03

Make the letter describe engineering, and describe it as temporary

The employer letter should set out actual engineering duties: design work, analysis, specification, testing, failure investigation, process or equipment development. It should name the employer, the work location, the salary and a defined period of employment, since TN work must be temporary in nature although it can be renewed. Avoid language describing the position as permanent or as a route to ownership. If the role also carries production management responsibilities, keep the engineering content clearly dominant, because a role that reads as operations management raises a different classification question entirely.
