THE SHORT ANSWER

Hypothetical example: a Conception Bay South operations manager at an offshore services company can probably be transferred under L-1, or could invest personally in an American business under E-2. The comparison usually focuses on cost. The more useful question is what happens if things go wrong, because an L-1 belongs to the employer and an E-2 belongs to the investor.

01

An L-1 is the employer's petition, not the employee's

The employer files, the employer pays and the status exists to allow that employer to employ that person in that role. If the employment ends, whether by redundancy, dismissal or resignation, the basis for the status ends with it, and the household's dependants are affected at the same moment because their status flows from the principal's. The employee cannot take the L-1 to a different company. There may be options in that situation, including a change of status if another employer will petition, but they depend on someone else's willingness and on timing, and none of them is within the employee's control.

02

An E-2 depends on a business the investor controls

A treaty investor's status rests on an enterprise the investor owns and directs, which puts the outcome largely in the investor's hands. Nobody can end it by making a personnel decision. The exposure is different rather than absent: the capital is committed and at risk, the business must remain real, operating and not marginal, and each renewal re-examines whether it still qualifies. A downturn is therefore an immigration problem as well as a commercial one. But the investor can respond to it, whereas an employee cannot respond to a decision made about their role.

03

Weigh control against capital, and write down which you value

The L route asks for no personal capital and offers no personal control of the permission. The treaty route asks for substantial capital irrevocably committed and gives control of the outcome, without any direct path to permanent residence and with the enterprise reassessed at each renewal. Neither is safer in the abstract; they distribute risk differently. Decide which failure the household could better absorb: the loss of capital in a business that did not perform, or the loss of status because an employer restructured. Write the answer down before comparing filing costs, because that is the choice actually being made.
