Read the general immigrant investor briefing overview
Hypothetical example: a Conception Bay South couple comparing EB-5 with the Gold Card ask what each will require of them after the money is paid. The two answers differ sharply. One creates years of continuing obligations to monitor a project, keep capital invested, maintain residence and produce evidence at the end. The other is defined entirely by whatever the official published material states, which is the reason to read that material for this question specifically rather than assume.
EB-5 involves the investor for years, in specific ways
The investor must be engaged in the management or policy formulation of the enterprise, which in a regional centre structure is ordinarily satisfied by the rights attached to a limited partnership interest, and in a direct investment requires actual involvement in running the business. Beyond that, a post-RIA investment must be expected to remain invested and at risk for at least two years, generally measured by USCIS from the date the full qualifying investment is made and placed at risk; a pre-RIA petition remains subject to the prior conditional-residence sustainment rule. Job creation must occur, and near the end of two years of conditional residence Form I-829 must be filed with evidence that the applicable requirements were met. The investor is also a conditional permanent resident throughout, with the residence expectations that status carries.
Read the official material for what the gift framework requires afterwards
Under the Gold Card framework the applicant gifts funds to the U.S. government and pays a processing fee. Whether anything is required of the applicant after payment, what the underlying immigrant category is, and how family members are treated are all matters stated by the government's published material, and they should be read from it directly rather than inferred. Save the page and note the date, because published terms can change. Where the material is silent on a point that matters, record it as unanswered and take advice, rather than assuming that silence means nothing is required.
Ask what each route needs from you in year three
That single question separates them usefully. For EB-5 in year three the household may be monitoring job creation, maintaining residence and preparing for condition removal; whether the capital must still be invested depends on the petition date, the investment date and the applicable sustainment rule. A shortfall in the requirements can have consequences for everybody in the family. For the gift framework the answer depends entirely on what the official page states, which is why reading it and writing down what it says is the first task rather than the last. Compare the two on that basis rather than on headline amounts, because the ongoing obligation is what a household actually lives with.
