THE SHORT ANSWER

Hypothetical example: a Mount Pearl L-1A manager relocates with a licensed-practical-nurse spouse, a 12-year-old and a son who is 20. Each member of that household has their own rule. The spouse of an L-1A manager is employment-authorized as an L-2; a child of 12 can study as an L-2; a son who is 20 at filing can be admitted as an L-2 but loses that status on his 21st birthday and needs his own basis to stay, such as student status, before then. Citizenship, age and intended activity, not the family's shared address, decide what each person may do.

01

Give the spouse's career its own plan

The spouse in the hypothetical above wants to keep nursing. As an L-2 spouse she is employment-authorized incident to status, so no separate immigration application is needed before she accepts a job. What she does need is the professional side: nursing in the destination state requires that state's licence, and certain health-care occupations require a health-care worker certification for admission in some categories. She should contact the state board early, gather her transcript and licence history, and expect that the licensing step, not immigration, sets her start date. If she is a Canadian permanent resident rather than a citizen, she may need a visa to enter as an L-2, but her work authorization is unaffected.

02

Enrol the child and record the son's birthday

The 12-year-old enters as an L-2 and may attend school on that status; no student visa is required. The 20-year-old is the household's time-sensitive case. He may be admitted as an L-2 if unmarried and under 21 on admission, but that status ends on his 21st birthday regardless of the manager's remaining L-1A period. Before that date he needs a status of his own. If he plans to attend a U.S. college, a change to student status should be filed while he is still in valid L-2 status, with the school's admission and financial documents. If he plans to work, no dependant status permits that; he would need his own route, and TN is open to him only with a listed credential. If he stays in Mount Pearl, nothing needs filing.

03

Keep every dependant tied to the principal's timeline

All L-2 status ends when the manager's L-1A ends, whether by the seven-year maximum, resignation or the company's decision. Extensions are filed for the family together, and a dependant who is outside the United States when an extension is approved may need a new admission. The family should keep each person's passport, admission record and, for the spouse, the annotated record that evidences her work authorization in one place. Marriage and birth certificates should be original or certified. If the family's plans include eventual permanent residence through the company, the son's age will be measured under the Child Status Protection Act at that stage, and the calculation is different from the L-2 rule; ask about it before assuming he can be included.
