IN THIS GUIDE · Trace a parent's gift as carefully as the investor's own money
Start with the EB-5 eligibility and application overview
Treat the donor as a second investor for documentation purposes
In the hypothetical above, the couple plans to invest US$800,000 in a regional-center project in a targeted employment area, roughly half from registered retirement savings and half as a gift from one spouse's father, a retired tradesman who sold a rental property. The father's gift must be shown to come from lawful funds: the property purchase and sale records, mortgage history, tax filings reflecting the rental income and the sale, and the bank statements showing the proceeds. A gift letter alone tells the officer what happened, not whether the money was lawfully earned.
Document the retirement withdrawals and their tax treatment
Withdrawing registered retirement savings to fund the investment creates a paper trail that is helpful, provided it is complete. Include the account statements before withdrawal, the withdrawal confirmations showing tax withheld, the deposit to the couple's chequing account and the wire to the investment escrow. Contributions to those accounts over the years came from employment income, so a decade of tax assessments explains the origin. Do not assume a long-held account is self-explanatory; the officer will ask how it was funded.
Confirm the project's job methodology and the couple's role
A regional-center project counts direct and indirect jobs through an approved economic model, and the couple should read the project's business plan and economic report to understand how ten jobs are attributed to their investment. Their engagement requirement is usually satisfied by rights as limited partners or members under the offering documents. Ask the regional center for the exemplar approval status, the job-creation cushion and the repayment terms, and treat the answers as commercial risk to weigh, not as immigration approval.
Plan the two-year condition and the family timeline
Approval of the investor petition leads to conditional permanent residence for the couple and their unmarried children under 21, obtained through consular processing or adjustment. Within the ninety days before the second anniversary they file Form I-829 with evidence the capital stayed invested and the jobs were created. Visa availability is set by the Visa Bulletin and can delay the residence step; check the current EB-5 categories for Canadian-born applicants. Children's ages are calculated under the Child Status Protection Act, which the family should review with actual birthdates rather than assumptions. The commercial decision is separate from the immigration threshold. Review the offering documents for deployment timing, project completion risk, repayment provisions, conflicts, and the risk that jobs are not created. Capital must remain at risk through the conditional period; a promised return or a guaranteed exit can undermine the required risk as well as the investment analysis.
