FOR BUSINESS LEADERS · MOUNT PEARLMount Pearl

Built in Canada.Ready for more.

Hypothetical example: a Mount Pearl building-supply distributor wants to move its branch operations manager to its U.S. subsidiary. That L-1A file will most often be tested on the definition of manager rather than on the corporate relationship. The transferee must have worked for the Canadian company for one continuous year within the three years before filing, the Canadian and U.S. entities must be parent, subsidiary, branch or affiliate and both must be operating, and the U.S. role must be primarily managerial or executive. A supervisor of hourly staff, however senior in title, is a first-line supervisor unless the people supervised are professionals or the person manages an essential function at a senior level. The organization chart on both sides of the border decides this question, so it should be drawn before the petition is written. The initial review should produce a before-and-after reporting chart, a calendar marking the qualifying foreign year, and a document list for ownership and active operations. That package exposes the decisive choice: whether the U.S. position can be supported as management now, or whether the company must first build the supervisory structure it says the transferee will lead.

Start with the L-1A eligibility and application overview

01

Draw the chart before you write the title

In the hypothetical above, the U.S. subsidiary runs a distribution centre. In Mount Pearl the operations manager manages a receiving supervisor, a dispatch supervisor and, through them, twenty-two warehouse and delivery staff. That is managerial work because the people she directs are themselves supervisors. If the U.S. centre has no supervisors and she would direct twelve forklift operators personally, the U.S. role is first-line supervision of non-professional staff and the petition is at risk regardless of the title on the letterhead.

02

Establish the year abroad with payroll, not with a letter

The one continuous year of qualifying employment must fall within the three years before the petition is filed, and time spent working in the United States for the same group does not count toward it. Prove the year with Canadian payroll records, T4 slips and a duties description that matches the period, rather than with a single letter that asserts it. If the transferee joined the Mount Pearl company fourteen months ago after working elsewhere, the earlier employer is irrelevant no matter how similar the work was; only employment with the qualifying organization counts.

03

Prove both entities are alive and connected

The corporate relationship is shown by share registers, articles and annual returns for both companies, plus evidence that the U.S. subsidiary is doing business: a lease, payroll, tax filings, customer invoices. A shell that exists only on paper does not support a transfer into an existing operation, and a subsidiary that ceased trading while the parent continued breaks the requirement that both remain active. If ownership passed through a holding company or a trust, include every link in the chain, because the officer will not infer common control from a shared name.

04

Describe the U.S. duties in percentages and reporting lines

The petition should state what proportion of the transferee's time will go to managing people or a function, setting policy, hiring and firing, and budget authority, and what proportion to hands-on operational tasks. A manager who spends most of the day driving a forklift because the centre is short-staffed is not primarily managerial. L-1A status can be extended to a maximum of seven years, and the L-2 spouse is authorized to work incident to status, which matters for a Mount Pearl household deciding who will earn what after the move. A useful board-level decision is whether the transfer remains appropriate for the expected assignment length. Keep dates for every period in L-1 status and for time spent outside the United States that may affect recapture. The seven-year L-1A ceiling is cumulative; a promising long-term employee should not be sent without considering the later residence strategy.
