FOR PROFESSIONALS · MOUNT PEARLMount Pearl

Your talent.A bigger stage.

Hypothetical example: a Mount Pearl hospital pharmacist is offered a clinical position at a U.S. regional hospital. Her TN eligibility is decided by three records: a Canadian passport, the listed profession of Pharmacist in USMCA Appendix 2, and a credential that line permits: a baccalaureate or Licenciatura degree or a state or provincial licence. The Newfoundland and Labrador licence answers the treaty qualification. Whether the pharmacist may actually dispense in the destination state is a separate question owned by that state's board of pharmacy, and a hospital offer does not answer either question on its own. Sorting the two apart early prevents arriving at the border with the wrong kind of proof. A first review should separate the employment letter from the professional file. Put the citizenship proof, the Appendix 2 profession, the named credential, and the actual U.S. duties on one page. That comparison tells the applicant whether a missing item concerns treaty eligibility, employer evidence, or state professional permission; those are different problems with different decision-makers.

Start with the TN eligibility and application overview

01

Separate the treaty qualification from the practice licence

In the hypothetical above, the pharmacist is licensed in Newfoundland and Labrador and the hospital is in a northern state. Her provincial licence satisfies the Appendix 2 credential for Pharmacist. The state board's own requirements for a Canadian-trained pharmacist, including any examinations, are a professional-regulation question that the hospital's credentialing office should confirm in writing. If the state permits work under a temporary or intern permit, the file should say so and say when the full licence is expected, because the officer will read the offer against the licence she actually holds.

02

Confirm the job is the profession, not adjacent to it

An offer that describes formulary management, medication reconciliation and clinical consultation reads as pharmacy. An offer that describes pharmacy-benefit sales, informatics implementation or supply-chain coordination may be work a pharmacist can do but is not necessarily work in the profession of Pharmacist. Ask the hospital to describe the duties in the support letter in plain terms that a non-pharmacist can match to the profession. Canadian permanent residents who are not citizens cannot use TN regardless of how strong the licence is, and a spouse who is a permanent resident should not assume a parallel route.

03

Fix the employment relationship and the ownership disclosure

Hospital pharmacists are usually direct employees, but some U.S. hospitals staff pharmacy through a management company. The support letter must come from the entity that pays and directs the pharmacist, and if a staffing intermediary is involved the file should explain who supervises the work. TN does not authorize self-employment in the United States, and any interest the pharmacist holds in a U.S. entity connected to the placement must be disclosed. Locum arrangements billed through her own corporation would need a different analysis before any travel.

04

Choose the application point and keep the description current

As a Canadian citizen she can apply at a port of entry or a preclearance location with the support letter, licence, transcript and proof of citizenship, or the hospital can file Form I-129 with USCIS in advance; no visa stamp is required. Fees follow the USCIS fee schedule. If the hospital changes the unit, the supervisor or the start date between the offer and the crossing, the letter should be reissued rather than explained verbally. A TN admission covers the described employment, so a changed job is a changed application. Before choosing a crossing date, compare the letter, proposed admission period, and first day of work line by line. The employer should retain a signed copy of the final letter. If its payroll entity or worksite has changed, a replacement letter is safer than an oral explanation, because the reviewing officer decides the application from the described employment rather than from future corrections.
