FOR SPECIALIST TEAMS · MOUNT PEARLMount Pearl

Your expertise.Across borders.

Hypothetical example: a Mount Pearl equipment manufacturer needs its process engineer to commission a line at a U.S. customer's plant. That L-1B petition succeeds or fails on whether the transferee's knowledge is special to the company's product, process or procedures rather than ordinary skill in the trade. The statute asks for specialized knowledge of the company's product and its application in international markets, or an advanced level of knowledge of the company's processes and procedures. The transferee still needs one continuous year with the Canadian entity within the three years before filing, the two companies must be qualifying related entities, and the U.S. role must actually use that knowledge. The evidence is strongest when it is arranged in the order the knowledge was acquired, so that the officer reads a history rather than a list of adjectives. At the first review, ask the business to identify the knowledge in a sentence that a project manager can verify, then identify the records that prove it. The resulting chronology should show what the specialist learned, why it matters to the U.S. assignment, and who inside the group can corroborate each step without relying on generic praise.

IN THIS GUIDE · Sequence the evidence so the knowledge is shown to be the company's, not the engineer's résumé

Start with the L-1B eligibility and application overview

01

Start the file with how the knowledge was built

In the hypothetical above, the company builds processing equipment for fish plants, and the engineer wrote and maintains its proprietary sanitation-line calibration procedure over four years of plant commissioning. The U.S. subsidiary has sold a line to a plant in New England. The petition should open with dated project records, training logs and the version history of the procedure, showing that the knowledge came from inside the company. A résumé that lists mechanical engineering skills any graduate could claim does not carry the case.

02

Explain why the knowledge is not general to the trade

The officer will ask whether another engineer with the same degree could do the job after ordinary training. Answer that question directly: describe what is proprietary about the calibration procedure, which parameters are specific to the company's equipment, and how long it takes a new hire in Mount Pearl to become competent. Comparisons with the company's own workforce are useful, and the knowledge need not be held by only one person. What matters is that it is distinct from common industry knowledge and that the U.S. entity cannot readily source it locally.

03

Keep control with the petitioner when the work is at a customer plant

Commissioning happens on the customer's floor. That is permitted only if the transferee remains supervised and controlled by the petitioning group and is providing specialized knowledge specific to the petitioner's product, not labour for hire supervised by the plant. The petition should state who assigns tasks, who evaluates performance and who pays the engineer, and should attach the equipment contract showing the commissioning obligation belongs to the company. A statement of work in which the customer directs the engineer's hours undermines the petition even when the knowledge is genuine.

04

Match the U.S. duties and duration to the knowledge

L-1B is limited to five years in total, and the role must continue to require the specialized knowledge. If the engineer will commission one line over four months and then stay to manage general service calls, the later work is not specialized-knowledge work and the petition should either describe a shorter assignment or a role that continues to use the proprietary process, such as training the subsidiary's technicians. The L-2 spouse is work-authorized incident to status, and L-2 children may study, which are family facts worth confirming before the engineer accepts. The company must also decide whether the planned assignment fits the available L-1B time. Record each earlier L-1 admission and any qualifying time abroad, then align the work plan to the five-year L-1B ceiling. A request for a long extension is harder to support when the specialized task has a short, defined end point.
