St. John’s: Should the gift be shown as an asset expected to earn a return?

Sources checked:

THE DIRECT ANSWER

No. A gift under the official framework should not be presented as a commercial investment promising returns. The September 7, 2026 official processing fee is US$15,000 per person and nonrefundable; the principal gift is US$1,000,000 individually or US$2,000,000 corporately. Family and continuing corporate obligations are additional.

Compare the actual financial commitments

Confirm current charges and gift terms without assuming repayment. Keep EB-5 project risk and capital requirements in a separate comparison. Hypothetical example: a precision-clock restoration business owner receives an adviser’s quote that combines government amounts and private services.

Build a payment chart that distinguishes official gift amounts, processing charges, professional help, tax advice, travel and any company-funded arrangement. Current federal materials settle official amounts and sequence; a bundled adviser quote does not. The business owner must decide whether a company contribution creates separate employment, tax or reimbursement issues while preserving the applicant’s required role in payment.

A frequent problem is describing a private service invoice as if it were a government amount. Retain official receipts and written instructions, and do not characterize the gift payment as a recoverable investment or conventional visa fee. Ask for an itemized estimate before spending, and compare it against official instructions so a private service cost is never misrepresented as government payment.
