IN THIS GUIDE · Make sure a controller's job is still an accountant's job
Start with the TN eligibility and application overview
The title that undoes the file
Hypothetical example: a Torbay CPA who prepares financial statements and manages audits for a provincial agency is offered a controller position at a U.S. manufacturing company. Controller is not on the list; Accountant is. An officer reads the employer's letter for what the person will do: preparing and analysing financial statements, applying accounting standards, managing the general ledger and audit, and tax compliance describe accounting; supervising a department, setting budgets and hiring describe management. A controller who does mainly the first set can be presented as an accountant. A letter that leads with staff supervision invites refusal, however qualified the applicant is. Before relying on a controller title, compare the job description, reporting line and performance measures. If the offer evaluates the person on audit quality, reporting accuracy and technical compliance, those records reinforce the accounting analysis. If it evaluates headcount, sales targets or enterprise strategy, the employer should consider a different classification rather than disguising the job.
The designation satisfies the credential rule; the degree is a fallback
The Accountant entry accepts a baccalaureate degree or a CPA, CA, CGA or CMA designation. A Torbay CPA therefore has two independent bases and should present the designation certificate and current membership in good standing as the primary credential, with the degree in support. Canadian permanent residents cannot use TN at all, and the credential does not cure that. Where the degree was earned outside North America and the designation is the sole basis, a credential evaluation is unnecessary; where the degree is the sole basis, it may be required. Good-standing proof should identify the named professional, the issuing body and its date. A screenshot without a visible date can create a needless question. Where a degree is being used instead, make the transcript, any required evaluation and the list qualification read as one sequence rather than separate, unexplained attachments.
Prearranged employment and the self-employment line
The position must be with a U.S. employer and must be prearranged; a TN cannot be used to enter and then seek work, and it cannot be used to provide services to a U.S. company the accountant owns or controls. An accountant who also runs a small bookkeeping practice in Torbay should disclose it; a Canadian business interest does not disqualify, but undisclosed ownership of the U.S. client would. If the offer comes through a professional-services firm placing the accountant at a client, the letter must show who employs, pays and supervises. Ask the hiring company to identify the legal employer, work location, supervisor, salary and finite period before finalizing the letter. A staffing arrangement is workable only when the documents consistently show who controls the professional work. A side agreement that gives the applicant control over the U.S. recipient is a reason to pause, because the category is not for self-directed U.S. business activity.
Port of entry, duration and dependants
A Canadian citizen presents the TN application at a U.S. port of entry or preclearance, or the employer files Form I-129; Canadians receive no visa stamp. Admission is for up to three years, renewable, but the position must remain temporary in nature and an application that describes an open-ended career move is weaker. Fees for the port application and for Form I-129 are published in the USCIS fee schedule, Form G-1055. A spouse and unmarried children under 21 may accompany in TD status and may study but may not work. Travel should follow an organized file, not replace it. A Canadian may request TN admission through inspection or the employer may seek approval by filing an I-129 petition with USCIS; each path still requires the same underlying professional, temporary and employer-based facts. Keep copies of the admission record and the employment letter, because later extensions depend on the continuing role.
