Can a Torbay CPA use TN for a U.S. controller position when controller is not a listed profession?

THE DIRECT ANSWER

Yes, if the actual duties are professional accounting and the employer's letter describes them that way. The list names Accountant; the job title is irrelevant, the work is decisive.

Present the work as accounting because it is accounting, not because it is convenient

Appendix 2 of USMCA lists Accountant with a baccalaureate degree or a CPA, CA, CGA or CMA designation as the qualification. A Torbay CPA offered a controller role qualifies if the position's substance is accounting work at a professional level: financial reporting, general-ledger control, audit management, technical accounting and tax compliance. Many controller roles are exactly that. The problem arises when the role is chiefly supervising a finance team, approving budgets and sitting on a management committee, which is management rather than the listed profession. The employer must describe the role truthfully; the reviewer's task is to determine whether the true role fits, not to rewrite it so that it does. Beyond the duties, the accountant must be a Canadian citizen, the employment must be prearranged and temporary, and the accountant must not own or control the employer. If the honest description is management, TN is the wrong route and an L-1A through a related company or another classification should be considered.

Hypothetical example: a Torbay accountant at a seafood-exporter is offered the title finance lead by a U.S. distributor. The first review compares the proposed duty list with ledger reconciliations, audit work papers and reporting assignments from the actual role. If those records show professional accounting, ask the employer to describe those functions specifically. If the role instead turns on supervising sales forecasts and company-wide operations, the truthful file identifies a management position and TN should not be used to force it into the Accountant entry.
