St. John’s: Can the transferring manager’s spouse work?

THE DIRECT ANSWER

A qualifying L spouse may be employment-authorized incident to status with appropriate documentation.

Check the spouse’s own admission and evidence

An employment authorization document is not universally required for a qualifying L spouse. The principal’s approval alone is not a substitute for reviewing the spouse’s actual status; children do not gain work permission solely from L dependent status. Hypothetical example: a commercial greenhouse president will transfer while a spouse is weighing local employment and a child is approaching adulthood.

Treat each family member’s plan as a separate compliance question. Relationship records and each person’s admission record settle the dependent classification, while the spouse’s planned activity determines whether additional employment evidence is needed. Sequence the family discussion before a job acceptance or school deposit.

Confusion often arises when a household assumes the principal’s approval notice alone proves every dependent’s ability to work or study. It does not. Keep copies of passports, marriage or birth records and admission information together, then revisit the plan whenever a child’s age, a work offer or the principal’s transfer dates change.
